On measures for the radical improvement of the activities of the State Committee of the Republic of Uzbekistan on Geology and Mineral Resources

Over the past period, the republic has carried out targeted implementation of a number of comprehensive measures to improve the efficiency of the use and protection of subsoil, ensure the rational use of mineral resources, and create conditions for the organization of modern industrial production in the regions.

A unified geological service has been created to implement state policy in the field of comprehensive geological study of the subsoil, effective implementation of programs for the development and reproduction of the mineral resource base in the long term.

At the same time, a study of the actual state of affairs indicates the presence of systemic problems that negatively affect the rational use and growth of mineral reserves, as well as investment attractiveness indicators in this area, in particular:

Firstly, there is no clear mechanism for implementing the powers of geological organizations in the area of rational use and protection of subsoil resources due to the implementation of similar functions by other regulatory bodies, as a result of which, when developing deposits, factors of the spatial location of minerals and the prospects for their further discovery are not taken into account;

secondly, the organizational and staffing structure of geological organizations does not allow for the mobilization of available resources to ensure full coverage of mineral extraction sites and the rational use of mineral resources, as well as the effective implementation of control over the use of subsoil;

thirdly, the areas of work and areas of activity between the State Committee of the Republic of Uzbekistan on Geology and Mineral Resources and its structural divisions are not specified, which leads to an irrational distribution of tasks and the implementation of duplicate functions;

fourthly, the insufficient implementation of modern information and communication technologies in the activities of geological organizations does not ensure the necessary level of transparency and efficiency in the provision of public services, effective interdepartmental cooperation on issues of subsoil use and protection;

fifthly, the low level of the current system of training, retraining and advanced training of specialists of geological organizations and their material incentives hinders the attraction of conscientious and highly qualified personnel, which in turn negatively affects the high-quality performance of geological exploration work.

In order to create a unified geological system, comprehensive assistance in attracting foreign investment, ensuring maximum transparency of public services provided, strengthening control over the rational use of subsoil, and in accordance with the objectives of the Action Strategy for five priority areas of development of the Republic of Uzbekistan in 2017-2021 and the Concept of administrative reform in the Republic of Uzbekistan:

1. Agree with the proposals of the State Committee on Geology and Mineral Resources (hereinafter referred to as the State Committee on Geology), the Prosecutor General's Office, the Ministry of Economy, the Ministry of Finance of the Republic of Uzbekistan, the State Committee of the Republic of Uzbekistan for Assistance to Privatized Enterprises and the Development of Competition:

a) on the transfer of functions for control over the use and protection of subsoil from the State Inspectorate for Supervision of Geological Survey of Subsoil, Safe Work in Industry, Mining and the Public Utilities Sector under the Cabinet of Ministers of the Republic of Uzbekistan (hereinafter referred to as GI "Sanoatgeokontekhnazorat") to the State Committee of the Republic of Uzbekistan on Geology and Mineral Resources;

b) on the formation of the Inspectorate for Control of Mining and Geological Activities (hereinafter referred to as the Inspectorate) and its regional inspectorates under the State Committee of the Republic of Uzbekistan on Geology and Mineral Resources with a total staff of 100 full-time positions.

2. To define the main tasks of the Inspectorate for Control of Mining and Geological Activities under the State Committee of the Republic of Uzbekistan for Geology and Mineral Resources as:

implementation of state supervision over compliance by legal entities and individuals with the requirements of legislation and regulatory documents in the field of use and protection of subsoil during their geological exploration, extraction of minerals (including fresh, mineral, thermal and industrial groundwater), processing of mineral raw materials, as well as geological and surveying support for mining operations;

control over the implementation by subsoil users of decisions and conclusions adopted upon approval of mineral reserves by the State Commission on Mineral Reserves under the State Committee of the Republic of Uzbekistan on Geology and Mineral Resources;

determination of the presence of permitted excess losses of minerals during the extraction and processing of mineral raw materials with the adoption of liability measures in accordance with the current legislation of the Republic of Uzbekistan.

3. Establish that the Inspectorate is a budgetary organization and its maintenance is carried out at the expense of the State Budget of the Republic of Uzbekistan, financial receipts from fines collected in the established manner for violation of established requirements in the sphere of subsoil use, and other sources not prohibited by law.

The State Committee on Geology shall, within two months, develop and submit in the established manner for approval to the Cabinet of Ministers of the Republic of Uzbekistan the Regulation on the Inspectorate for Control of Mining and Geological Activities under the State Committee of the Republic of Uzbekistan for Geology and Mineral Resources.

4. Create a State Commission on Mineral Reserves under the State Committee on Geology, abolishing the State Commission on Mineral Reserves under the Cabinet of Ministers of the Republic of Uzbekistan.

To define the main tasks of the State Commission on Mineral Reserves:

approval of conditions for the reliable calculation of mineral reserves that meet the requirements for the most complete and comprehensive development of deposit reserves on a rational economic and environmental basis;

approval of reserves of all types of minerals, ensuring the development of the mineral resource base of the republic;

conducting state examination of geological materials;

implementation of a unified policy in the area of establishing optimal principles for the classification and calculation of mineral reserves, their geological and economic assessment and determination of industrial significance.

The State Committee on Geology shall, within two months, develop and submit in the established manner for approval to the Cabinet of Ministers of the Republic of Uzbekistan the Regulation on the State Commission on Mineral Reserves under the State Committee of the Republic of Uzbekistan on Geology and Mineral Resources.

5. Establish a procedure according to which:

permission for special water use and water consumption in terms of groundwater is issued by territorial hydrogeological stations of the State Committee on Geology through State Service Centers in the established manner;

permits for the right to use subsoil areas are issued by the State Committee on Geology through the “License” information system in accordance with the established procedure;

the approval in the established manner of plans for the development of mining operations submitted by subsoil users, as well as the acceptance of annual reports on the volumes of their production and subsequent redirection to the State Geological Fund of the State Committee on Geology is carried out according to:

non-metallic minerals - territorial divisions of the Inspectorate;

ore minerals and hydrocarbons - Inspection.

In this case, the application for obtaining permits specified in paragraphs two and three of this clause, and the documents attached to it, can also be submitted through the Unified Portal of Interactive Government Services.

6. To define the main tasks and areas of activity of the State Committee of the Republic of Uzbekistan on Geology and Mineral Resources:

first - the implementation of a unified state policy in the field of geological exploration, use and protection of subsoil resources, as well as the management of mining relations;

the second is the accelerated development of the mineral resource base of the republic, primarily groundwater, precious, non-ferrous, rare, rare earth metals and uranium, the accelerated search for new types of mineral raw materials and their deposits;

third - increasing the efficiency and effectiveness of geological exploration work, ensuring an increase in mineral reserves and the reproduction of the mineral resource base of economic sectors, taking into account the creation of new industrial capacities on the ground;

fourth - conducting an active investment policy in the field of geological exploration and industrial development of mineral deposits and creating a favorable investment climate;

fifth - preparation of proposals for diversification of raw material sources of existing industries, primarily in the regions of the republic, for the organization of modern production facilities for the production of competitive products;

sixth - ensuring monitoring and control over the implementation of long-term, medium-term and annual state programs for the development and reproduction of the mineral resource base, an objective assessment of the methodology for geological exploration of the subsoil, the volume, quality and reliability of their results;

seventh - implementation of state supervision over compliance by legal entities and individuals with the requirements of legislation and regulatory documents in the field of use and protection of subsoil during their geological exploration, extraction of minerals (including fresh, mineral, thermal and industrial groundwater), processing of mineral raw materials, as well as geological and surveying support for mining operations;

eighth - the implementation of effective measures to modernize the geological industry through the accelerated introduction of modern high-performance geological exploration equipment, provision of advanced technology and innovative technologies;

ninth - the implementation of systemic measures to train highly qualified personnel with higher and secondary specialized, professional education for the geological industry, retraining and advanced training of workers in the geological industry, as well as improving the mechanisms for stimulating their work.

7. To form in the central office of the State Committee on Geology:

Main Directorate for the Development and Reproduction of the Mineral Resource Base;

Administration of public services in the field of geology;

Science and Innovation Directorate;

Directorate of Technical Policy;

Department of Mineral Reserves;

Department of Control and Executive Discipline;

Department for handling appeals;

Department of Public Relations and Mass Media.

8. To approve the Set of measures for the reorganization and main tasks of subordinate organizations of the State Committee of the Republic of Uzbekistan for Geology and Mineral Resources in accordance with Appendix No. 2 .

12. Determine that:

the central office of the State Committee on Geology is maintained through contributions from subordinate organizations and other sources not prohibited by law;

The Chairman of the State Committee on Geology has the right to engage as consultants, within the framework of the implementation of the tasks assigned to the State Committee on Geology, highly qualified specialists from government agencies and other organizations, leading design institutes, scientific and educational institutions, as well as, if necessary, expert consultants from international organizations, foreign companies and experienced practitioners.

13. Within two months, the State Committee on Geology shall ensure that the central office of the State Committee on Geology and its subordinate organizations are staffed with highly qualified specialists who possess the necessary theoretical knowledge and practical skills and are capable of professionally implementing the tasks assigned to the State Committee on Geology.

14. The Cabinet of Ministers of the Republic of Uzbekistan shall, within one month, approve the Regulation on the State Committee of the Republic of Uzbekistan for Geology and Mineral Resources.

15. The State Committee on Geology, the Ministry for the Development of Information Technologies and Communications of the Republic of Uzbekistan, together with interested ministries and departments, shall, by July 1, 2018, integrate the State Committee on Geology database with the information systems of authorized state bodies and other organizations into a single system of interdepartmental electronic interaction to improve and accelerate the process of data exchange, as well as the issuance of permits in the field of subsoil use.

Determine the source of funding for activities to integrate the State Committee on Geology database as funds from the Information and Communication Technologies Development Fund.

16. Determine that from April 1, 2018:

employees of the State Committee on Geology are paid bonuses for continuous length of service (length of service) in the amounts established for employees of the State Enterprise Navoi Mining and Metallurgical Plant and the Joint-Stock Company Almalyk Mining and Metallurgical Plant;

district (territorial) coefficients to wages for employees of subordinate organizations of the State Committee on Geology, located in the corresponding territories of the republic, are established in the amounts determined for employees of the State Enterprise "Navoi Mining and Metallurgical Plant" in accordance with the Resolution of the Cabinet of Ministers of the Republic of Uzbekistan dated April 24, 2017 No. 232;

the maximum amount for calculating district (territorial) coefficients to the salaries of employees of the State Committee on Geology is 2.11 times the minimum wage established in the territory of the Republic of Uzbekistan;

18. To the State Committee of the Republic of Uzbekistan on Geology and Mineral Resources:

a) within two weeks, make changes to the cost estimates and staffing schedules of the State Committee on Geology and its subordinate organizations in accordance with this resolution;

b) within three months, together with interested ministries and departments, develop and submit to the Cabinet of Ministers of the Republic of Uzbekistan:

draft laws of the Republic of Uzbekistan "On the establishment of the day of workers in the field of geology of the Republic of Uzbekistan", "On the establishment of the honorary title of the Republic of Uzbekistan "Uzbekistan Republic geologist";

the draft Law of the Republic of Uzbekistan "On Amendments and Additions to the Law of the Republic of Uzbekistan "On Subsoil"" taking into account the strengthening of the role and responsibility of the State Committee on Geology, its subordinate organizations and local government bodies in the field of subsoil use, as well as the creation of favorable conditions for pursuing an active investment policy in this area;

proposals for amendments and additions to legislation arising from this resolution;

c) within two weeks, jointly with the Ministry of Finance of the Republic of Uzbekistan, based on the requirements of paragraph 2 of clause 16 of this resolution, submit proposals for amendments to Chapter 5 of Appendix No. 1 to the Resolution of the Cabinet of Ministers of the Republic of Uzbekistan dated July 13, 2017 No. 494 “On approval of the updated Regulation on the State Committee of the Republic of Uzbekistan for Geology and Mineral Resources and measures to stimulate workers in the geological industry”;

d) ensure that the regulatory legal acts adopted by it are brought into compliance with this resolution by 1 May 2018.

19. Paragraph four of clause 4 of the Resolution of the President of the Republic of Uzbekistan dated September 13, 2016 No. PP-2589 “On measures to further improve the organization of research in the field of geological study of the subsoil” shall be set out as follows:

"The source of funding for the activities of the Institute of Geology and Geophysics named after Kh. M. Abdullaev are funds from the State Budget of the Republic of Uzbekistan, allocated to the State Committee on Geology within the framework of annual State programs for the development and reproduction of the mineral resource base, grants allocated based on the results of competitions held by the Ministry of Innovative Development of the Republic of Uzbekistan, revenues from economic activities, grants from international organizations, as well as other sources not prohibited by law."

20. To declare certain decrees of the President of the Republic of Uzbekistan as no longer in force in accordance with Appendix No. 7 .

21. Control over the implementation of this resolution shall be assigned to the Deputy Prime Minister of the Republic of Uzbekistan - Chairman of the Board of JSC Uzbekneftegaz A.S. Sultanov and the Chairman of the State Committee of the Republic of Uzbekistan for Geology and Mineral Resources B.F. Islamov.
