On measures to improve the efficiency of preparation and implementation of projects with the participation of international financial institutions and foreign government financial organizations

In order to further improve the efficiency of preparation and implementation of projects with the participation of international financial institutions and foreign government financial organizations:

2. Establish that:

heads of ministries and departments that have signed financial agreements, refinancing agreements, project agreements, subsidiary agreements, agreements on delegation of rights and claims, letters of agreement and other agreements (hereinafter referred to as project agreements) are authorized to sign, on behalf of the Republic of Uzbekistan or the Government of the Republic of Uzbekistan, changes, additions and amendments to project agreements in the manner established by this resolution;

legal opinions on signed agreements on projects for which the provision of legal opinions is a condition for entry into force, as well as on state guarantees are issued by the Ministry of Justice in a form acceptable to international financial institutions and foreign government financial organizations (hereinafter referred to as IFIs/FGOs), within a week after the agreements and guarantees are submitted to the Ministry of Justice of the Republic of Uzbekistan;

payment of compensation for the seizure of land plots, demolition of houses, other buildings, structures or plantings within the framework of the implementation of projects with the participation of IFIs/IPFOs, if this is provided for in the project agreements, is carried out by authorized bodies in accordance with the requirements of the IFIs/IPFOs;

within the framework of the implementation of projects with the participation of IFIs/IFFOs, by July 1, 2021, the purchased goods (works, services) and vehicles are exempt from customs duties (except for customs fees) according to the list formed in the established manner, value added tax, fees to state target funds, legal entities - non-residents of the Republic of Uzbekistan - from paying corporate income tax, individuals - non-residents of the Republic of Uzbekistan - from paying personal income tax;

In the case of provision of paid consulting services by MFIs, they are the sole suppliers of these services, with whom direct contracts are concluded, subject to registration in a special information portal.

3. Determine that:

Registration of entry visas for foreign specialists participating in the implementation of projects with the participation of IFIs/IFFOs is carried out by the Ministry of Foreign Affairs of the Republic of Uzbekistan upon requests from project initiators or implementing agencies without charging consular or other fees;

The issuance and extension of multiple-entry visas and registration at the place of temporary residence of foreign specialists participating in the implementation of projects with the participation of IFIs/IFFOs are carried out by the Ministry of Internal Affairs of the Republic of Uzbekistan upon applications from project initiators or implementing agencies without charging a state fee.

4. The Working Commission for the Coordination of the Development of the Draft Tax Code of the Republic of Uzbekistan in a New Edition and the Abolition of Ineffective Tax and Customs Benefits and Preferences (B. Mavlonov) shall provide for:

a) exemption for the period of implementation of projects with the participation of IFIs/IFFOs and the warranty period:

goods (works, services) and vehicles purchased using funds from the International Financial Institution/Institution of Funds (IFI/IFFO) - from the payment of customs duties (except for customs duties), value added tax, as well as fees to state target funds;

legal entities - non-residents of the Republic of Uzbekistan - from paying corporate income tax;

individuals - non-residents of the Republic of Uzbekistan - from paying personal income tax;

b) extension of the benefits provided for in subparagraph “a” of this paragraph to goods (works, services) and vehicles purchased using funds from the State Budget of the Republic of Uzbekistan, the own funds of project initiators and implementing agencies within the framework of the implementation of projects with the participation of IFIs/IFFOs.

Determine that the amount of funds released as a result of the provision of benefits is the contribution of the Republic of Uzbekistan to the implementation of projects with the participation of IFIs/IFFOs.

5. The State Investment Committee of the Republic of Uzbekistan, together with the Ministry of Justice, shall, within one month, submit to the Cabinet of Ministers proposals on amendments and additions to legislation arising from this resolution.

6. Control over the implementation of this resolution shall be assigned to the Prime Minister of the Republic of Uzbekistan A.N. Aripov and the Deputy Prime Minister of the Republic of Uzbekistan - Chairman of the State Investment Committee of the Republic of Uzbekistan S.R. Kholmuradov.
