On measures to radically improve licensing and permitting procedures
In recent years, the republic has been implementing consistent measures to radically improve the business and investment climate, eliminate unnecessary bureaucratic barriers, and improve outdated procedures that do not meet modern requirements.
The work carried out in these areas has created a solid foundation for the beginning of a new stage of liberalization and institutional reform of the licensing and permitting system.
In order to radically improve licensing and permitting procedures, as well as to create broader conditions for the activities of business entities by eliminating bureaucratic barriers:
1. Agree with the proposals of the Ministry of Justice, the Commissioner for the Protection of the Rights and Legitimate Interests of Entrepreneurs, the Antimonopoly Committee and the Chamber of Commerce and Industry, which provide for:
at the first stage (in 2020) - reduction and transition to alternative methods of regulation of certain types of licenses and permitting documents that do not cause harm to the health of citizens and society, simplification of procedures in order to minimize the request for unnecessary documents and reduce the time and money costs of business entities, ensuring transparency through the complete digitalization of the processes for issuing relevant documents;
at the second stage (in 2020-2021) - systematization of legislative acts in the field of licensing and issuing permits, development of passports for the provision of public services, a radical reduction in the number of regulatory legal acts by introducing standard administrative regulations for issuing certain types of licenses and permitting documents.
2. Establish that from January 1, 2021:
a) certain types of licensed activities and permitting documents:
are cancelled in accordance with Appendix No. 1 * ;
are cancelled by unification in accordance with Appendix No. 2 * ;
are cancelled by introducing the notification procedure in accordance with Appendix No. 3 * ;
b) the time periods for processing certain types of licensed activities and permitting documents are reduced in accordance with Appendix No. 4 * .
Licenses or permitting documents issued for an activity (action) in respect of which a notification procedure has been introduced remain in effect and notification of the authorized body is not required to carry out this activity (action).
The bodies authorized to issue licenses and permitting documents, as well as to accept notifications (hereinafter referred to as authorized bodies) shall conduct an inventory and ensure the maintenance of a register of previously issued licenses and permitting documents based on the new procedure by January 1, 2021.
3. To approve the Plan of Measures aimed at further reducing and simplifying the procedures for obtaining licenses and permitting documents, in accordance with Appendix No. 5 * .

4. From January 1, 2021:
a) establish that when licensing tourism activities, certification of tour operator services is voluntary;
b) cancel:
requirement for documents confirming consent to exchange credit information with at least 10 commercial banks when licensing the activities of credit bureaus;
the practice of issuing a separate license for branches of legal entities by introducing the practice of indicating the address of each branch in the main license when licensing activities for the retail sale of medicines and medical devices by legal entities licensed for this activity, when creating their branches that carry out similar activities;
the procedure for requesting from the applicant letters of guarantee from local government authorities when obtaining a license for the right to use subsoil areas.
5. Establish that:
activities carried out by notification procedure include types of activities that do not require a decision to be made by an authorized body to commence an activity or perform an action, but are carried out by accepting obligations to comply with the requirements and conditions established in legislative acts to ensure state regulation, as well as maintaining records of entities engaged in the relevant activities;
individuals and legal entities confirm by sending a notification their compliance with the requirements and conditions defined in legislative acts for the implementation of activities or actions for which a notification procedure has been introduced. In this case, in the process of submitting documents via an automated electronic system, a check is carried out for compliance with the requirements and conditions defined in legislative acts, primarily without human intervention;
The lists of types of activities for which a license, permitting documents and notification of the authorized body are required are approved by law and after the adoption of the relevant law, the requirement for individuals and legal entities to undergo administrative procedures to carry out activities or actions not included in these lists is not permitted.
6. Prohibit authorized bodies from carrying out the following actions:
refuse to provide public services due to the presence of debt of the license applicant for mandatory payments for the supply of electricity, natural gas, water supply and sewerage services, for the collection and removal of solid household waste, as well as for enforcement documents when issuing, extending the validity period and reissuing licenses;
replace licenses and permitting documents with agreements concluded between government agencies and business entities;
directly or indirectly compel business entities to use other types of paid services or to obtain permitting documents not provided for in the licensing and permitting requirements and conditions, in the process of reviewing applications for the issuance of licenses and permitting documents, issuing these documents, and also in the implementation of control functions.
7. Extend until January 1, 2021 the validity period of all licenses and permitting documents that expire in 2020 and prohibit liability and the application of other measures in connection with their expiration.
8. To cancel, from January 1, 2021, the right to carry out activities without obtaining an appropriate license for state unitary enterprises and non-governmental organizations engaged in licensed types of activities created by decisions of the President of the Republic of Uzbekistan or the Cabinet of Ministers.
9. The Ministry of Justice, together with the Ministry for the Development of Information Technology and Communications, shall ensure the development and launch of the “License” information system with a special mobile application by January 1, 2021, covering all processes related to licensing procedures, issuing permits and notifications, with the ability to implement interdepartmental electronic interaction.
It should be taken into account that the “License” information system has the following capabilities:
a) upon completion of licensing, permitting and notification procedures:
filing an application for the issuance of a license and permitting documents or extension of their validity and documents attached to it, obtaining electronic licenses and permitting documents with a QR code (matrix bar code);
consideration of applications and making decisions on the issuance or refusal to issue licenses and permitting documents by authorized bodies;
sending notifications to notify the authorized body of the commencement or termination of activities and receiving confirmation of acceptance of the notification;
implementation of electronic payment of state duties, fees and all types of payments for consideration of an application through the Unified Billing System;
acceptance and consideration of applications for re-registration, suspension and cancellation of licenses and permitting documents;
b) on the interaction of authorized bodies in the implementation of licensing, permitting and notification procedures:
independently obtaining additional documents and information from other authorized bodies, as well as coordinating with them on the “one-stop shop” principle without the participation of the business entity;
maintaining automated registers of issued licenses and permitting documents, as well as business entities that have submitted notifications;
verification of information related to licenses and permitting documents, as well as notifications through the databases of the relevant departments in automatic mode;
c) to monitor the implementation of the requirements and conditions of licenses and permitting documents, as well as notifications:
implementation of remote monitoring by authorized bodies of compliance with the requirements and conditions of licenses and permitting documents, as well as notifications;
monitoring the consideration of applications at each stage of the provision of public services;
appeals by authorized bodies to the court or other departments regarding actions related to licenses or permitting documents, as well as notifications, including those related to cancellation and suspension;
the introduction of public control over the consideration of applications, decisions on the issuance or refusal to issue, suspension of licenses and permitting documents, as well as the provision of information on engaging in relevant activities without a license or permitting document or without sending a notification, as well as facts of violation of established requirements and conditions with a direct indication of the location of the violation;
maintaining an automatically generated rating of authorized bodies;
implementation of a risk analysis system based on the specifics of licenses and permitting documents issued by authorized bodies, as well as activities carried out in accordance with the notification procedure, with the definition of specific criteria for monitoring the activities (actions) of individuals and legal entities.
10. Establish a procedure according to which, from January 1, 2021:

licensing, permitting and notification procedures are carried out in stages entirely in electronic form through the “License” information system or the Unified Portal of Interactive Government Services, with the exception of procedures containing state secrets and information, access to which is restricted in accordance with the law;

applications for the issuance of a license and permitting documents, as well as for notification of the authorized body and the documents attached to them, are accepted in electronic form via the Internet through the Unified Portal of Interactive Government Services;
all types of licenses and permitting documents, as well as letters of acceptance of notifications and their inclusion in the register, are issued by entering a QR code (matrix bar code), which provides the ability to online verify the authenticity of these documents, and the procedure for issuing them on special forms is cancelled, with the exception of documents requiring execution on special paper forms in accordance with international treaties;
obtaining additional documents or coordinating them with other authorized bodies is carried out by the main authorized body independently, without the participation of the business entity, through the "License" information system, including by connecting to an integrated platform that does not require a response, allowing information to be received directly. In the absence of a response from other authorized bodies within the established time frame, additional documents are considered to be received or coordinated with them, and these authorized bodies are responsible for all possible consequences;
individuals who have identified instances of the relevant activity being carried out without a license or without a permit document or without sending a notification, also related to the violation of established requirements and conditions, as well as cases of violation of the law when authorized bodies consider applications, issue licenses and permit documents or refuse to issue them, as well as suspend their validity, and who have reported them to authorized bodies, are encouraged by a monetary reward in the amount of 10 percent of the amount of the fine collected upon confirmation of the violation;
termination and cancellation of licenses and permitting documents at the initiative of authorized bodies are carried out exclusively through the courts, with the exception of cases of failure by the licensee to pay the state fee for the issuance of a license;
when a license applicant who has a license for the right to carry out a type of activity in a certain area applies for a license for a type of activity in the same area, he submits to the licensing authority information that satisfies only additional licensing requirements and conditions;
When notifying the authorized body of the commencement of activities, a fee of up to 50 percent of the basic calculation amount is charged, with the exception of notifications of the commencement of construction and installation work and the retail sale of alcoholic beverages.
11. Take note that the “License” information system is being developed on the basis of an open tender with the involvement of grant funds from the joint project of the State Services Agency, the United Nations Development Programme and the European Union “Improving the provision of public services and increasing the level of governance in rural areas of Uzbekistan”.
In connection with the development of the “License” information system, suspend the development by government departments and organizations of all electronic programs for the implementation of licensing procedures, issuance of permits and notifications, as well as control over their requirements and conditions, while the development of these programs may be continued in accordance with a positive conclusion from the Ministry of Justice and the Ministry for the Development of Information Technology and Communications.
The funds intended for programs whose development is suspended shall be directed towards the creation of departmental infrastructure and databases necessary for the functioning of the “License” information system.

12. Designate the Ministry of Justice as the authorized body for maintaining the “License” information system and authorize it to monitor compliance by government agencies and other organizations with licensing procedures, issuance of permitting documents, and notifications.

13. Work on improving the “License” information system, as well as organizing its integration with departmental information systems of government agencies, shall be carried out using funds from the Ministry of Justice’s Public Services Development Fund and other sources not prohibited by law.

The Ministry of Justice, within six months after the full launch of the “License” information system, shall transfer it, in accordance with the established procedure, to the Ministry for the Development of Information Technologies and Communications free of charge.

14. Establish that:
each licensing, permitting and notification procedure is reviewed at least once every five years with an assessment of the goals achieved as a result of its implementation, the current state of socio-economic, innovative and technological development, as well as the costs of business entities;
if the draft regulatory legal act provides for the introduction of a new type of licensed activity, a permit document or a procedure for notification of the commencement of an activity, conducting an assessment of the regulatory impact of this procedure is mandatory;

a draft regulatory legal act providing for the introduction of new types of licenses, permitting documents and the procedure for notification of the commencement of activities, as well as changes in the forms of their regulation, is submitted to the Ministry of Justice only if there are positive conclusions from the Ministry of Economic Development and Poverty Reduction and the Committee for the Development of Competition and Consumer Protection, agreed upon with the Commissioner for the Protection of the Rights and Legitimate Interests of Business Entities and the Chamber of Commerce and Industry.

15. To the Ministry of Justice, the Ministry of Economic Development and Poverty Reduction, the State Tax Committee and the Chamber of Commerce and Industry, for the implementation of the second stage of the comprehensive and systemic reform of licensing and permitting procedures with the involvement of business entities:
a) within three months, by combining the laws “ On licensing of certain types of activities ” and “ On permitting procedures in the sphere of entrepreneurial activity ”, submit to the Cabinet of Ministers a comprehensive draft law providing for:
establishment of a unified and transparent procedure for completing licensing, permitting and notification procedures;
determination of the powers of authorized bodies and organizations that issue and approve licenses and permitting documents, as well as accept notifications;
implementation of a unified system for protecting the rights and interests of individuals and legal entities entering into relationships with authorized bodies and organizations in the process of undergoing licensing and permitting procedures;
approval of the list of licensed types of activities, permitting documents in the field of entrepreneurial activity, as well as activities and actions carried out in accordance with the procedure for notifying the authorized body;
establishing licensing requirements and conditions in legislative acts by abandoning the practice of drawing up licensing agreements;
clarification of the procedure for branches and representative offices of legal entities to carry out activities that require licensing, obtaining a permit or notification;
a specific definition of the procedure for revocation of a license and the types of activities subject to revocation in accordance with this procedure;
implementation of control over the state of compliance with licensing and permitting requirements and conditions by implementing a risk analysis system;
b) together with the Commissioner for the Protection of the Rights and Legitimate Interests of Business Entities, the Antimonopoly Committee and authorized bodies, in order to systematize legislative acts in the field of licensing and permitting procedures, by February 1, 2021, submit to the Cabinet of Ministers a draft regulatory legal act on the development and codification of their passports.
16. The Ministry of Justice shall submit to the Cabinet of Ministers:
together with the Prosecutor General's Office, within three months, a draft law establishing the liability of legal entities and individuals for engaging in activities that require obtaining a license or a permit document or mandatory notification, without obtaining a license or permit or without sending notification, as well as for submitting to the authorized body false or inaccurate information on the fulfillment of the established requirements for carrying out activities in accordance with the notification procedure;
until December 1, 2020, the procedure for rewarding individuals who have identified and sent reports of relevant violations to authorized bodies;
together with interested ministries and departments, within three months, proposals on changes and additions to legislation arising from this Decree.
17. In order to ensure the effective and timely implementation of the measures provided for in this Decree:
a) Deputy Prime Minister D. Kuchkarov, in connection with the introduction of a notification procedure instead of certain types of licensing and permitting procedures, shall ensure the approval of provisions on the notification procedure after the adoption of the relevant law;
b) To the Ministry of Justice (Davletov):
approve a schedule for organizing meetings with authorized bodies, including through an online video communication system;
on the basis of the approved schedule, explain to the authorized bodies the procedures provided for in this Decree and the principles of operation of the “License” information system;
provide practical assistance to authorized bodies in the preparation of relevant projects;
c) To the Ministry for the Development of Information Technologies and Communications (Sadikov):
together with the Ministry of Justice, take measures to ensure integration with the “License” information system of departmental information systems of all government agencies issuing licenses and permitting documents participating in the approval processes;

ensure the uninterrupted functioning of the “License” information system; if the Ministry of Justice detects any failures or malfunctions in its functioning, ensure, at the request of the Ministry, that they are eliminated within three days;

d) authorized bodies:
within two months, take measures to connect to the “License” information system and integrate their electronic systems, create the appropriate infrastructure and form their electronic databases;
to develop in a timely and high-quality manner regulations on the procedure for undergoing licensing and permitting procedures for certain types of activities carried out, as well as the notification procedure;
ensure, in accordance with the established procedure, the issuance of licenses to organizations created by decisions of the President of the Republic of Uzbekistan and the Government and engaged in licensed activities, prior to the adoption of this Decree, on the basis of their requests;
d) To the Prosecutor General's Office (Yuldoshev):
together with the Anti-Corruption Agency and the Commissioner for the Protection of the Rights and Legitimate Interests of Business Entities, establish systematic control over the implementation of legislation in the area of licensing procedures, issuance of permits and notifications;
analyze the reasons and conditions that led to the automatic issuance of licenses, permitting documents, including positive conclusions during interdepartmental approval due to failure to meet established deadlines, and take measures to prevent the emergence of corruption;

e) The Committee for the Development of Competition and Protection of Consumer Rights (Sharakhmetov) shall prevent the restriction of competition by impeding the access (conduct of activities) of new economic entities to markets through unjustified refusal or inaction in the process of issuing licenses, permitting documents and notifications, and shall also exercise control over the validity of the formation of the amounts of fees for permitting procedures;

g) The Commissioner for the Protection of the Rights and Legitimate Interests of Entrepreneurs (Kasimov) shall exercise control over the inspections by authorized bodies of the activities of entities that have a license and permits, within the limits of the requirements of licenses and permits;
h) The Agency for Information and Mass Communications (Khodjaev), together with the National Information Agency of Uzbekistan and the National Television and Radio Broadcasting Company of Uzbekistan, shall take measures to widely publicize the measures established in this Decree, with the involvement of the mass media, domestic and foreign experts, as well as civil society institutions.
18. Control over the implementation of this Decree shall be assigned to the Prime Minister of the Republic of Uzbekistan A.N. Aripov and the Head of the Administration of the President of the Republic of Uzbekistan Z.Sh. Nizomiddinov.
